Acceptance of Terms

By accessing and using the services provided by Clevia B.V. ("Clevia", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. These terms apply to all visitors, users, and others who access or use our construction services and website.

Services Description

Clevia provides residential construction services including but not limited to custom home construction, home renovations, extensions, and project management. All services are subject to separate written agreements that will detail specific terms, timelines, costs, and deliverables for each project.

User Obligations

You agree to provide accurate and complete information when requesting our services, comply with all applicable laws and regulations, provide safe and reasonable access to construction sites, make payments according to agreed schedules, and communicate any changes or concerns promptly. You are responsible for obtaining any necessary permits or approvals unless otherwise specified in our service agreement.

Payment Terms

Payment terms will be specified in individual project contracts. Generally, payments are due according to project milestones or as otherwise agreed. Late payments may incur interest charges. All prices are quoted in Euros and include applicable VAT unless otherwise stated. We reserve the right to suspend work for non-payment.

Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, and software, is the property of Clevia or its content suppliers and is protected by Dutch and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without express written permission. Project designs and plans remain the intellectual property of their respective creators.

Warranties and Guarantees

We provide warranties on our construction work as specified in individual project contracts. Warranty periods vary depending on the type of work performed. We guarantee that all work will be performed in accordance with industry standards and applicable building codes. Warranty claims must be reported promptly and in writing.

Limitation of Liability

To the maximum extent permitted by law, Clevia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses. Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

Force Majeure

Clevia shall not be liable for any failure to perform due to unforeseen circumstances or causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government regulations, or supply chain disruptions. In such cases, we will make reasonable efforts to notify you and resume performance as soon as practicable.

Changes and Variations

Any changes to the scope of work must be agreed upon in writing and may affect project timelines and costs. We reserve the right to modify these terms at any time. Material changes will be communicated to you with reasonable notice. Continued use of our services after changes constitutes acceptance of the modified terms.

Termination

Either party may terminate a service agreement with written notice as specified in the individual contract. Upon termination, you agree to pay for all work completed and materials supplied up to the termination date. Clevia reserves the right to terminate services immediately for non-payment, safety violations, or breach of contract terms.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these terms. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Dispute Resolution

We encourage resolution of disputes through direct communication. If disputes cannot be resolved amicably, they may be submitted to mediation. Any unresolved disputes shall be subject to the exclusive jurisdiction of the Dutch courts, and Dutch law shall apply to the interpretation and enforcement of these terms.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Netherlands. Any legal proceedings arising from these terms shall be subject to the exclusive jurisdiction of the competent courts in Utrecht, Netherlands. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely approximates the intent and economic effect of the invalid provision.

Entire Agreement

These terms, together with our Privacy Policy and any specific project contracts, constitute the entire agreement between you and Clevia regarding our services. These terms supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter herein.
